Representation of a mother in a family law case – alimony for minor children

Our firm represented a mother in a family law case, in a trial related to alimony for three minor children. The father who abandoned the common residence did not pay any amount as alimony, claiming financial problems. Our firm lodged an interim measures application before Athens First Instance Court. The defendant claimed that he was unemployed, presented zero income through his tax statements and requested to pay a minimum amount as alimony.

The Court accepted our legal arguments and obliged the defendant to pay alimony which was calculated on the basis of the amount that the defendant should or could have earned taking into consideration the common knowledge notorious facts and not the declared income through his tax statement (Judgment No: 7487/2016).
